About Lakeshore

1. Agreement

By booking, renting, or using services provided by Lakeshore Kayak Adventures (“we,” “our,” or “us”), you (“Customer”) agree to these Terms and Conditions. If you do not agree, do not use our services.

2. Booking & Rental

• Reservation: All rentals require prior booking through our website, phone, or in person. Bookings are confirmed only upon receipt of a booking confirmation email.
• Rental Period: The rental period commences at the specified time and concludes upon return of the kayak and equipment. Late returns will incur additional charges.
• Availability: Rentals are subject to availability. If we cannot fulfil a booking, we will notify you and provide either a full refund or the option to reschedule.

3. Payment

• Pricing: All prices are in CAD; applicable taxes are excluded. Prices may vary; you will be charged the confirmed price at booking.
• Payment: Payment must be made in full at the time of booking via credit card or other accepted methods.

4. Liability & Assumption of Risk
• Risk: Customer acknowledges the inherent risks associated with kayaking, including injury or damage. Customers assume all risk.
• Waiver: By renting from us, you agree to sign a waiver of liability, releasing us from any liability for injury, loss, or damage incurred during the rental period.
• Indemnity: You agree to indemnify and hold harmless Lakeshore Kayak Adventures from any claims, damages, or liabilities arising from your use of the kayaks.

5. Insurance
• Personal Insurance: We do not provide insurance for personal injury or liability. Customers are advised to obtain their own insurance coverage.
• Damages: Customers are responsible for any damage to kayaks or equipment, and will be charged for repairs or replacement costs.

6. Usage Rules
• Safety: Life jackets must be worn at all times.
• Prohibited Activities: Alcohol, drugs, and unsafe activities are prohibited.
• Geographic Restrictions: Rentals are limited to designated areas. Customers must comply with all local waterway regulations.

7. Cancellations & Refunds
• Customer Cancellations:
• Full Refund: Cancellations made at least 48 hours prior to rental.
• 50% Refund: Cancellations made 24–48 hours before rental.
• No Refund: Cancellations made within 24 hours or no-shows.
• Cancellations by Us: In case of unsafe conditions or equipment failure, we will offer a full refund or reschedule.
• Refund Process: Refunds will be processed within 7 business days to the original payment method.

8. Governing Law
These Terms are governed by the laws of Ontario, Canada. Any disputes will be subject to the exclusive jurisdiction of Ontario courts.
